Labor Conciliation Board

The German Works Council Constitution Act demands and assumes trusting, good faith cooperation between the employer and the works council. Unfortunately, this does not always take place in real life. In such cases a so-called labor conciliation board is provided by Law in matters that require co-determination.

The goal is to find an amicable arrangement in the conciliation board that fairly reflects the parties’ interests. If this is not possible, the conciliation board’s ruling follows. In such cases the issue at hand is to achieve the negotiation objective still by vote in the board.
